Fact: Dr J S Kanoria who carried out the post mortem of the woman, Kausarbanu, on 2 March 2002 found that her womb was intact, and that she had died of burns suffered in the riots.
Weekly India Today dated 5 April 2010 reports:
“Significantly, in March 2003, the SC had stalled the trial of nine Gujarat riot cases, thanks to the relentless campaign by the human rights activists seeking justice for the Muslim victims. The riot victims said they won’t get justice as long as the Gujarat Government had a role in the police probe and the subsequent trial. The SIT is reinvestigating the cases under the virtual supervision of the apex court, with even the judges and public prosecutors being selected under the SC’s monitoring.
As the SIT goes about its task, more and more evidence is surfacing that the human rights lobby had, in many cases, spun macabre stories of rape and brutal killings by tutoring witnesses before the SC. In the process, it might have played a significant role in misleading the SC to suit its political objectives against Modi and his government.
Last week, one of the most horrible examples of cruelty resurfaced once again as the trial of the Naroda Patiya case, where 94 persons were killed, began in the SC-monitored special court in Ahmedabad. Soon after the riots, the human rights activists and the Muslim witnesses had alleged that a pregnant woman Kausarbanu’s womb was ripped open by rioters and the foetus was flung out at the point of a sword. The gruesome incident was seen as the worst-possible example of medieval vandalism in the modern age.
Last week, eight years after the alleged incident, Dr J.S. Kanoria, who conducted the post-mortem on Kausarbanu’s body on March 2, 2002, denied that any such incident had ever happened. Instead, he told the court: “After the post-mortem, I found that her foetus was intact and that she had died of burns suffered during the riot.” Later Kanoria, 40, told INDIA TODAY, “I have told the court what I had already written in my post-mortem report eight years ago. The press should have checked the report before believing that her womb was ripped open. As far as I remember, I did her post-mortem at noon on March 2, 2002.”
A careful study of the three police complaints, claiming that Kausarbanu’s womb was ripped open by the rioters, shows several loopholes. While one complaint accuses Guddu Chara, one of the main accused in the Naroda Patiya case, of ripping open Kausarbanu’s womb, extracting her foetus and flinging it with a sword; another complaint accuses Babu Bajrangi, yet another accused in the case, of doing the act. A third complaint, on the other hand, does not name the accused but describes the alleged act.
Modi will also have reasons to smile at the affidavits filed by the Muslim witnesses in the SC in 2003 at the behest of Citizens for Justice and Peace (CJP) and Teesta Setalvad on the basis of which the trial in nine cases were stalled for six long years. The most glaring hole is in the affidavit of Nanumiya Malek, a key witness in the Naroda Gam case. In his affidavit before the SC filed on November 15, 2003, Malek stated that a newly married woman called Madina, who lost four of her relatives, including her husband in the riots, had been raped by the rioters.
Malek’s affidavit states: “I was witness to the crimes of murder and rape that took place on Madina and her family. I also saw seven people being burnt alive, including four orphans. I request the SC to keep the details of this rape victim confidential since she is alive and use it only for the purpose of trial and conviction of the rapists.” But on May 5, 2009, in his statement before the SIT, Malek said: “I had wrongly claimed that Madina had been raped. I made the charge because of Teesta Setalvad’s pressure. I kept on telling her not to include that charge in my affidavit, yet it was included.”
In her statement before the SIT on May 20, 2008, Madina, who has remarried now, said: “The charge made by Malek claiming that I was raped by a riotous mob is false. I wasn’t raped. When the riotous mob put my house on fire, I tried to run but was attacked by a rioter who injured me with a knife. Later I managed to merge in a Muslim crowd.”
There are six other affidavits filed by different Muslim witnesses on November 15, 2003, that wantonly allege rape in the Naroda Gam and Naroda Patiya riot cases without giving any details. Interestingly, all the affidavits have a uniform language: “Over 110 persons were not simply killed, but raped and mutilated as well, including young children. We urge the SC to stay the trials and transfer them to a neighbouring state and also order fresh investigation.” The affidavits state that they had been filed at the behest of Setalvad and in the presence of her co-activist Rais Khan.
If this wasn’t enough, other glaring attempts by human rights activists to tutor witnesses have come to the fore. For example, soon after the Gulberg massacre in which Ehsan Jafri was killed, nearly a dozen Muslim witnesses told the police that Jafri had fired in self-defence, killed a rioter and injured 14 others. They also said that this led the mob to resort to violence and attack Muslims in Gulberg with vengeance. But almost half of them who deposed before the special court have retracted from this statement.
The statement of Imtiaz Pathan in the Gulberg trial also raises eyebrows. He told the special court that before being killed, Jafri told him that Narendra Modi abused him (Jafri) on phone when he sought protection during a mob attack. Incidentally, there is no record available of Jafri having made any call to Modi. Pathan didn’t name Modi in the first police statement he made soon after the riots. Interestingly, he has also identified as many as 27 individual attackers from a mob of thousands of rioters.
When the SIT started taking statements of witnesses in the Gulberg Society case, around 20 witnesses came with typed statements. But the SIT objected to it, citing Section 161 of the CRPC, saying that the police must record the statement of a witness. So when the SIT forced the witnesses to give their statement during the interrogation, there was a vast difference between the ‘readymade typed’ statements and the oral evidence that the police had received earlier.
As a senior lawyer defending the accused puts it: “The witnesses under the influence of the human rights activists didn’t allow videotaping of their statements while they were being recorded. There is an obvious attempt on the part of activists to dictate not just the SIT, but also the courts.” Last week, INDIA TODAY quizzed Setalvad about the charge of tutoring the witnesses and creating false evidence before the courts in the 2002 Gujarat riot cases.

Kanoria showed his post-mortem report to the court saying he found the fetus intact in the woman’s womb itself. The fetus weighed 2,500 g and was 45 cm long. He mentioned about burn injuries in his post-mortem note, but was quiet on whether there was any other injury on the body.
In April last year, the Gujarat government argued before the SC on this case after SIT submitted a report in a sealed cover. The government’s claim was that SIT had refuted charges that Kausar Bano’s fetus was pulled out of her womb and killed by sword before her eyes by violent mob. Senior counsel Mukul Rohatgi contended that such allegations levelled by an NGO were proved false by SIT report. (The Supreme Court-appointed SIT had already said in its report in April 2009 that there is no truth in the allegation that Kausar Bano’s womb was ripped open and foetus taken out. Note that this SIT was appointed by highly anti-Modi judges like Aftab Alam, Arijit Pasayat etc). Nearly a year later, the doctor, considered a neutral witness, has deposed the same before the trial court.”

Perhaps the only other newspaper to even report Dr Kanoria’s statement in court was The Hindu. The Hindu too has lied and called the riots a ‘pogrom’, ‘genocide’ and ‘massacre’ of Muslims ever after the riots and published white lies on this subject on its edit page. But even it reported:

As a large number of bodies were arriving at the Ahmedabad civil hospital, Dr. Kanoria was specially summoned there from the Nadiad hospital and he conducted post-mortem on three bodies including that of a pregnant woman, who was later identified as Kausarbanu…”

“We had just finished having tea around 9:30 a.m. when we heard a mob outside. They were throwing stones, brandishing swords, dharias and khanjars and chanting ‘Jai Shri Ram.’ They said they would destroy all Muslims. We tried to run but they had surrounded us. They set fire to houses and started throwing people into the flames. I was standing with my pregnant cousin Qausarbibi, who was to deliver in another two days. They dragged her away, ripped open her stomach with a knife and threw the foetus into the fire. Then they threw my family into the fire, one by one: my father, mother and my 17-year-old sister Sophiya. My aunt’s family was also burnt alive.
“Someone hit me with a pipe and I fainted. When I came to, it was night. There were corpses all around me. My pants had been burnt off. I walked to my house and put on some clothes. Then, I walked 6 or 7 miles in the night to the house of my employer. All along the way, I feared someone would leap out and kill me. He took me to the hospital and then they brought me to this camp.
“I feel like my mind has been destroyed. I can’t talk for more than a few minutes. I can’t sleep at night. Those scenes keep coming back to me. I think about my mother a lot. She used to say that I was her joy, her support. I want to ask the people who did this: What had my family ever done to you? I don’t think all Hindus are bad. I had four or five Hindu friends in my colony and I can’t believe that they were involved. It was outsiders who did this.
“I feel scared to leave the camp but sometimes I think I have already lost everything. What can I feel scared of now? When [Indian Prime Minister A.B.] Vajpayeeji had come to visit Gujarat, he spoke to me and asked me about my problems. But I want to know, what has he done to stop the killing? When is it going to end?”

1- BJP/RSS people are too soft and dont have self-confidence to file defamation cases. They also fear that Congress has bought all judges and put members of its legal cell in the judiciary.
Just because they didnt file defamation cases doesnt mean this information is wrong. On the contrary, if this information was not true, HOSTILE UPA GOVT WOULD NOT SPARED MODI and in 2004 itself would have tried to hang him. But because, all this is true, no one has ever been able to prove anything against Modi.
But yes, I agree with you fully that they should file cases. I have said this many many times to those idiots- both in India and also Australia.
2- You should read what Ram Madhav said after that sting operation. Any stray man talking nonsense (like a drunkard)- how does that indict RSS leader Indresh Kumar? Anyone will say anything- how can a third person be blamed for that? And by the way, Ram Madhav told Headlines Today that RSS is thinking of legal action. Luckily, RSS filed some cases against Sitaram Kesri and other Congress leaders in the past- and won.
3- Cases being transfered out of the state and what happened int he 2002 riots are different things. And most of the cases are in Gujarat only. Only 2 cases were shifted out- Best Bakery and Bilkis Bano. And in Gujarat also, many Hindus were convicted for rioting. On 14 Dec 2005 and 30 October 2007 Hindus were convicted.
4- Absolutely right on BJP. A section of BJP itself is against Modi and hence do nothing. BJP however has criticized media for its reporting on this issue. Ravishankar Prasad has done that, and the then BJP chief Krishnamoorthy had also said this- on record.

By the way- these 4 points raised by you do not even address anything said in this site and refute it on any point. The Narendra Modi government in Gujarat is in a spot following the summons issued to Minister of State for Home Amit Shah in connection with the Sohrabuddin Sheikh fake encounter case.
Prashanth Dayal, the journalist who broke the story in 2005, told rediff.com that Shah, who is Modi’s most trusted aide in the government, “is not likely show up even after the second summons has been issued. It is clear that the minister is likely to avoid the Central Bureau of Investigation, and the agency will be forced to issue a third summons.”
The Gujarat government has been shaken up by this new turn of events. It is to be seen, before their legal options run out, if Modi will seek Shah’s resignation or not. Dayal claims that “the CBI has in its possession ample evidence against Shah to prove his involvement in the case.”
So far, what the CBI has claimed to the media, in off the record briefings, is that there are telephonic conversations and supportive statements from the arrested accused in the case to establish that Shah nurtured a gang of 25 police officers to undertake such work
It is also evident that this was a fake encounter; the Gujarat government has itself admitted so before the Supreme Court.
Rajasthan’s powerful marble lobby, which complained of extortion by Sohrabuddin, was behind the fake encounter, Dayal claims.
He, however, feels that Modi will dillydally over Shah’s resignation. The minister is his troubleshooter and if at all he is removed from office, it will be very hard to find a replacement. Also, it is not possible that Shah acted on his own in 2005, when Modi was so powerful.
The government in Gujarat is in disarray over this development and shaken. However, once the third summons is issued, there will be no option for Modi but to seek Shah’s resignation because after the interrogation if some prima facie evidence is found, the CBI can arrest him.
However, Shah is a product of the Rashtriya Swayamsevak Sangh culture and it is unlikely that he will drag his boss Modi into the case although it is believed that the CM was aware of it.
Observers say that while Shah will feel let down by Modi, he will not take on the latter as in that case outside help from the party and RSS cadres will be lost.

– The pattern of violence does not indicate “spontaneous” action. There was pre-planning, organization, and precision in the targeting.
– There is compelling evidence of sexual violence against women. These crimes against women have been grossly underreported and the exact extent of these crimes – in rural and urban areas – demands further investigation. Among the women surviving in relief camps, are many who have suffered the most bestial forms of sexual violence – including rape, gang rape, mass rape, stripping, insertion of objects into their body, stripping, molestations. A majority of rape victims have been burnt alive.
– There is evidence of State and Police complicity in perpetuating crimes against women. No effort was made to protect women. No Mahila Police was deployed. State and Police complicity in these crimes is continuing, as women survivors continue to be denied the right to file FIRs. There is no existing institutional mechanism in Gujarat through which women can seek justice.
– The impact on women has been physical, economic and psychological. On all three fronts there is no evidence of State efforts to help them.
– The state of the relief camps, as mothers struggle to keep their children alive in the most appalling physical conditions, is indicative of the continued abdication of the State’s responsibilities.
– Rural women have been affected by communal violence on this scale for the first time. There is a need for further investigation into the role played by particular castes/communities in rural Gujarat in unleashing violence.
– There is evidence that the current carnage was preceded by an escalation of tension and build-up by the VHP and the Bajrang Dal.
– There is an alarming trend towards ghettoisation of the Muslim community in rural areas for the first time.
– Sections of the Gujarati vernacular press played a dangerous and criminal role in promoting the violence, particularly in provoking sexual violence against women.

NO ONE gives into stupid debates like CONGRESS HAS LOOTED india for 50 years, because if that was the case, people in India would be like Pakistanis, not enjoying in clubs, parties and all over. Poverty is a true fact in india, but BJP is not a magic party that it can eliminate poverty in 5 years.
BJP and its ideology only works by arousing emotions, not by imparting wisdom, for the fact if any of its leaders ever had any wisdom, they would have been accepted at the national stage.

Muslim women were subjected to “unimaginable inhuman and barbaric” sexual violence during recent communal riots in the west Indian state of Gujarat, according to a woman’s panel that has visited the state.
Many women suffered the worst forms of sexual violence, including gang-rape, says their report, “How has the Gujarat massacre affected minority women. The survivors speak”, released on Tuesday.
The violence began when 58 passengers were killed when a train carrying Hindu activists was torched on 27 February. It led to one of the worst bouts of Hindu-Muslim violence in the state.
The official death toll in last month’s riots has now risen to 778, although welfare groups put the figure at about 2000.
‘Complicity’
Most of the rape victims were burnt alive, Tuesday’s report says.
Many Muslim women were also left homeless
The head of the team, Syeda Hameed, told a Delhi press conference that the impact of such violence on women has been physical, economic and psychological.
The team – one of the first to visit Gujarat in the aftermath of the riots – says it found evidence of police complicity in perpetrating crime against women.
They allege that the police refused to file complaints by the victims.
The team also demanded the announcement of a special compensation package.
The panel also demanded that a special tribunal be set up to ensure justice for victims.
The report also said there was no evidence of any support from the state authorities in Gujarat to help women who had suffered attack.
Special guards
In parliament on Tuesday, junior Home Minister ID Swamy said the Gujarat Government had taken a pro-active role in supporting relief camps run by non-government organisations and that essential commodities were being supplied.
Meanwhile, the Gujarat Government announced special security measures to ensure protection to nearly 200,000 students who will be taking exams from Thursday.
Gujarat’s Education Minister Anandi Patel says special buses guarded by the police will be made available to help students travel in six riot-affected districts where exams have been postponed.
Sporadic violence in Gujarat’s main city, Ahmedabad, has continued with another death in police firing during clashes between Hindus and Muslims late on Monday night.
At least 11 areas of Ahmedabad district are still under curfew.
